What You Need to Know
Scorpions are hardy, low-maintenance arachnids known for their nocturnal habits, burrowing behaviour and long lifespan, with some species living up to 15 years in captivity. They need a secure, escape-proof enclosure of at least 10 gallons (roughly 38 litres), moisture-retaining substrate for burrowing, a shallow water source and a diet of appropriately sized live insects. Are Scorpions Legal to Keep in NSW?
Native, unprotected invertebrates – including native Australian scorpions – can generally be kept in NSW without a specific wildlife keeper’s licence, unlike native reptiles, frogs, birds and mammals which fall under their own licensing categories. Exotic (non-native) scorpion species, such as the Emperor Scorpion commonly seen overseas, are not permitted to be brought into or kept in Australia.
What Could Happen If You Own an Illegal Scorpion?
Keeping a non-native scorpion species is a biosecurity offence in Australia, similar to cases involving illegally kept exotic reptiles. Past enforcement has included fines under the NSW Biosecurity Act (one case involving an illegally kept python resulted in a fine of around $5,000), along with potential seizure and euthanasia of the animal. Sticking to native, legally sourced scorpions like ours avoids this risk entirely, while still giving you a genuinely fascinating pet.
